Subject: – Pension parity case before the Hon’ble Supreme Court due to SLP filed by the GOI against the order of the Division Bench of the Hon’ble Rajsthan High Court Jodhpur Bench).
You are aware that AIRRBEA has been fighting organizationally for Pension Parity since a pretty long time besides legal battle started by us in 2003 by filing WP of the AIRRBEA before the Hon’ble Karnataka High Court.
By this time Hon’ble Karnataka High Court gave Judgement in March, 2011 in favour of the Pension Parity in RRBs, Hon’ble Rajasthan High Court also, both Single Bench and Division Bench, delivered the Judgement in favour of Pension Parity in RRBs almost in line with the Judgement of Hon’ble Karnataka High Court.
On 31-01-2014 Division Bench of Hon’ble Karnataka High Court dismissed the appeal of the GOI filed against the Judgement of the Single Bench.
Now the Pension Parity case is pending before the Hon’ble Supreme Court due to the SLP filed by the GOI in August, 2012 against the order of the Division Bench of the Rajasthan High Court.
AIRRBEA leadership has taken the matter with due seriousness and engaged Senior Advocates to fight the case appropriately. By this time the matter has been listed several times but could not be heard for disposal due to listing of our applications at the later positions.
Our Advocate Sri C K Sasi and his Senior today (18-02-2014) made Appeal before the Hon’ble Chief Justice for early hearing of the case on the ground that so many RRB staff have retired by this time and are facing untold suffering/hardship, and also with background that in February, 2013 the Hon’ble Supreme Court bench with Sri P Sadashivan, presently the Hon’ble Chief Justice gave the order to list our cases for final disposal.
This appeal has been allowed and the matter will be listed in March, 2014 for final hearing as per the direction of the Hon’ble Chief Justice.
Comrades, AIRRBEA leadership is aware of the hardship faced by more than 8000 RRB staff and their families after facing their superannuation/retirement and are taking all possible measures so that Pension Parity in line with the scheme out of agreement signed on 29-10-1993 in the Banking Industry is properly implemented in RRBs retrospectively to cover all the retired/deceased staff and their families.
We assure all concerned that the AIRRBEA team is always active and serious enough in the matter and we firmly believe that the issue will be resolved by the order of the Hon’ble Court as per the early hearing allowed on this date.
